Article 1 – GENERAL AND LEGAL INFORMATION.
NEW BRUSSELS AQUARIUMS is an aquarium shop that has been located in Brussels for over 30 years and offers a sales area of over 200m².
These conditions are concluded between NEW BRUSSELS AQUARIUMS, operated by SA COMPAGNIE INTERNATIONALE D'AQUARIOPHILIE D'AGENCEMENT ET D'AGREMENT, abbreviated CIA, registered with the Crossroads Bank for Enterprises under number 0441.618.036, whose registered office is located at 1000 Brussels, Boulevard Barthélémy, 39, and persons making a purchase on the website www.brusselsaquariums.be , hereinafter referred to as "the Consumer or the User".

These terms and conditions define the sales agreement between NEW BRUSSELS AQUARIUMS and the Consumer and apply to any User who registers on its website. The parties expressly agree that their relationship will be governed exclusively by these terms and conditions and, in the absence of any other provision, by Belgian law. The Consumer declares that they have the full legal capacity to enter into this agreement.
Article 2 – THE ORDER.
All website users and consumers must complete the registration process and provide all necessary information to confirm their order. Using the online product lists, consumers will select the items they wish to purchase by submitting an online order form. By submitting their order online, consumers enter into a sales contract with NEW BRUSSELS AQUARIUMS and expressly acknowledge having read and agreed to these terms and conditions. Consumers will receive an order confirmation email.
All orders will be honored within the limits of available product stocks and if not, NEW BRUSSELS AQUARIUMS will inform the Consumer of availability delays.
Article 3 – THE PRICE.
The prices of the products shown on our website are indicated in euros and include all taxes, excluding delivery charges.
NEW BRUSSELS AQUARIUMS reserves the right to change its prices at any time and products will be billed based on the prices in effect at the time the orders are registered.
Article 4 – DELIVERY METHODS
NEW BRUSSELS AQUARIUMS offers the most suitable delivery methods at reasonable prices. Delivery charges are in line with the rates charged by the postal service and other transport companies. Additional charges may apply for express delivery. Products ordered on our website are shipped within the Eurozone and outside the Eurozone, depending on the services and rates offered by the aforementioned companies.
If the item is in stock, delivery times will vary between 2 and 7 days from the date of order confirmation to the Consumer. If a product is unavailable, NEW BRUSSELS AQUARIUMS will confirm its possible availability and the delivery time, which may vary between 15 and 60 business days from the date of order confirmation to the Consumer. If unavailability is confirmed, the Consumer will have the option to cancel their order. Should the aforementioned delivery times not be met, NEW BRUSSELS AQUARIUMS undertakes to find a solution with the Consumer, consisting of agreeing on an extended delivery time, offering a similar alternative product, or, if neither of the first two options is possible, issuing a voucher.
All deliveries are made on working days, excluding weekends and public holidays.
Upon delivery, you are required to check that your order is correct. If you accept the order, it will be considered accepted without reservation. If you refuse delivery, you must notify NEW BRUSSELS AQUARIUMS by email at [email protected] within 24 hours of delivery.
In case of delayed delivery or loss of the package, you are required to contact NEW BRUSSELS AQUARIUMS by email: [email protected] .
NEW BRUSSELS AQUARIUMS may exclude liability in the event of force majeure, namely, any irresistible event or circumstance, external to the parties, unforeseeable, unavoidable, independent of the will of the parties and which cannot be avoided by the latter.
In such circumstances, the party concerned must inform the other party as soon as the event occurs.
Without this list being exhaustive, the following force majeure events will release NEW BRUSSELS AQUARIUMS from its delivery obligation, namely: war, acts of terrorism, revolt, fire, earthquakes, storms, floods, lightning, strikes, accidents, lack of supply by its supplier or lack of transport by the transport company, blockages of means of transport, unavailability of telecommunications and delivery networks.
In the event of unavailability of its website or telephone network, NEW BRUSSELS AQUARIUMS will take all necessary measures to remedy the problems, without the consumer being able to claim termination of the contract and/or the awarding of damages.
Article 5 – PAYMENT.
Payment for your purchases is processed at the time of ordering. All payments are made online via the secure servers of PayPal and VivaWallet.
The consumer guarantees that they have all the necessary authorizations to use the payment method and NEW BRUSSELS AQUARIUMS reserves the right to suspend any order and/or delivery in the event of refusal of payment by bank or credit card by banking institutions.
NEW BRUSSELS AQUARIUMS also reserves the right to refuse to make a delivery and/or to fulfill an order from a Consumer with whom a payment dispute is ongoing.
Article 6 – RIGHT OF WITHDRAWAL.
In the case of online sales, the Consumer has the right to withdraw from their purchase within 14 calendar days from the date of receipt of their order. This right of withdrawal does not apply if you have ordered perishable goods, custom-made items (such as an aquarium), or if you have unsealed the products.
NEW BRUSSELS AQUARIUMS will not accept cancellation from the Consumer if the original packaging of the product has not remained intact and in particular if the seal and the product have been used and/or damaged.
The Consumer must inform NEW BRUSSELS AQUARIUMS in writing of their intention to cancel their purchase. This notification must be made by registered mail or email ( [email protected] ). If the package is returned, and after notifying NEW BRUSSELS AQUARIUMS of the cancellation within the aforementioned timeframe, the Consumer must take the utmost care in protecting the returned product(s), and the return shipping costs will always be borne by the Consumer.
The Consumer will return the product(s) to NEW BRUSSELS AQUARIUMS within a maximum of 7 days from the date of their cancellation notification.
NEW BRUSSELS AQUARIUMS will process the refund within 30 days of receiving the returned product(s).
A bank transfer will be made by NEW BRUSSELS AQUARIUMS provided that the Consumer has informed them beforehand of their bank account number.
It is important to note that the payment platform's transaction fees will be deducted from the refund.
Return shipping costs are not refundable and in case of abusive returns or damaged packages, NEW BRUSSELS AQUARIUMS reserves the right to refuse refund and/or confirmation of a subsequent order.
Article 7 – GUARANTEES.
All items sold on our site are covered by the legal guarantee, which lasts for two years from the date of the purchase invoice.
In case of any problem or defect concerning your item, the Consumer will return the item to NEW BRUSSELS AQUARIUMS at their own expense, along with a copy of the invoice.
The warranty applies only under normal use of the appliance. If defects result from causes external to the appliance (accident, fall, impact, electrical short circuit, etc.), misuse, installation not in accordance with the manufacturer's specifications, or fault on the part of the consumer (improper storage of the appliance, improper use of unsuitable peripherals, accessories, or consumables), the warranty will be automatically voided, and the consumer will be responsible for the cost of estimates and repairs. The consumer is required to carefully read the manufacturer's or brand's instruction manual.
In the event of hidden defects and manufacturing flaws, a repair will be carried out free of charge and if repair is impossible, the device will be replaced by an equivalent model whose depreciation will be taken into account according to the date of purchase.
The warranty will also be excluded if the product has been modified, repaired, integrated or added to by the Consumer or any other person not authorized by the Manufacturer.
Also excluded from the guarantee are all live items and frozen food.
Upon discovery of a product non-conformity, the Consumer is required to inform NEW BRUSSELS AQUARIUMS customer service directly via email at [email protected] .
Article 8 – LIABILITY.
NEW BRUSSELS AQUARIUMS offers and sells products that comply with Belgian legislation and cannot be held responsible for non-compliance with foreign legislation.
NEW BRUSSELS AQUARIUMS is bound by an obligation of means and its liability cannot be engaged for any inconvenience or damage whatsoever inherent in the use of the internet network including a service interruption, an external intrusion or the presence of a computer virus, or any event qualified as force majeure.
NEW BRUSSELS AQUARIUMS cannot be held responsible for damages of any kind resulting from malfunction or misuse of the products sold or from any modifications made by suppliers.
NEW BRUSSELS AQUARIUMS cannot be held liable to the Consumer or to any third party for any event whatsoever, for non-performance of the contract resulting from a stock shortage or unavailability of the product or service or from a case of force majeure.
NEW BRUSSELS AQUARIUMS cannot guarantee continuous and secure access to its website. It offers no guarantee against any failure related to an intrusion into the computer system and/or the presence of a virus or errors that may affect certain website functionalities. NEW BRUSSELS AQUARIUMS will not be held liable in the event of website unavailability or force majeure.

Respect for your privacy and personal information is our priority. We are committed to complying with the obligations arising from the law on privacy and the Regulation on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016). We do not retain any personal data, except for that which you agree to provide to us for the conclusion and execution of sales contracts concluded through our website. Article 11 – APPLICABLE LAW AND JURISDICTION.
These terms and conditions are governed by Belgian law. In the event of a dispute, only the Courts and Tribunals of the French-speaking judicial district of Brussels shall have jurisdiction, regardless of the place of delivery or the method of payment accepted.
