Terms and Conditions of Sale

Article 1 – GENERAL AND LEGAL INFORMATION.

NEW BRUSSELS AQUARIUMS is an aquarium store that has been in existence in 1000 Brussels for over 30 years and offers a retail space of over 200m².

These terms and conditions are concluded between NEW BRUSSELS AQUARIUMS, operated by S.A. COMPAGNIE INTERNATIONALE D'AQUARIOPHILIE D'AGENCEMENT ET D'AGREMENT, abbreviated as C.I.A., registered with the Crossroads Bank for Enterprises under number 0441.618.036, with its registered office at 39, Boulevard Barthélémy, 1000 Brussels, and individuals making a purchase on the website www.brusselsaquariums.be, hereinafter referred to as "the Consumer or the User".

These general terms and conditions define the terms of sale between NEW BRUSSELS AQUARIUMS and the Consumer and apply to any User who registers on its website. The parties expressly agree that their relations will be governed exclusively by these general terms and conditions and, in the absence of any condition, they will be governed by Belgian law. The Consumer declares to have full legal capacity allowing him/her to be bound by these general terms and conditions.

Article 2 – THE ORDER.

Any User of the site or Consumer must follow the registration procedure and provide all necessary data for order confirmation. Using the lists of products displayed online, the Consumer will transmit the items he/she wishes to purchase by validating an online order form. By validating his/her online order, the Consumer concludes a sales contract with NEW BRUSSELS AQUARIUMS and expressly acknowledges having read and agreed to these general terms and conditions. The Consumer will receive an order confirmation email.

All orders will be honored within the limits of available product stock and, failing that, NEW BRUSSELS AQUARIUMS will inform the Consumer of availability times.

Article 3 – THE PRICE.

The prices of the products presented on our website are indicated in euros and include all taxes, excluding delivery charges.

NEW BRUSSELS AQUARIUMS reserves the right to modify its prices at any time and products will be invoiced based on the prices in force at the time the orders are registered.

Article 4 – DELIVERY METHODS

NEW BRUSSELS AQUARIUMS offers the most appropriate delivery methods at reasonable rates. Delivery costs comply with the rates charged by the Post Office and other transport companies. In case of express delivery, additional charges may apply. The shipment of products ordered on our website is carried out within the EURO zone and beyond, depending on the services and rates applied by the aforementioned companies.

If stock is available, delivery times will vary between 2 and 7 days from the order confirmation to the Consumer. In case of product unavailability, NEW BRUSSELS AQUARIUMS will confirm the possible availability of a product and the delivery time, which may vary between 15 and 60 working days from the order confirmation to the Consumer. In case of confirmed unavailability, the Consumer will have the option to cancel his/her order.

All deliveries are made on working days, excluding weekends and public holidays.

At the time of delivery, you are required to check the conformity of your order. In case of refusal of delivery, you are required to notify NEW BRUSSELS AQUARIUMS by e-mail: info@brusselsaquariums.be within 24 hours.

NEW BRUSSELS AQUARIUMS may exclude its liability in case of force majeure: war, acts of terrorism, revolt, fire, earthquakes, storms, floods, lightning, strikes, accidents, lack of supply or transport, blockages of transport means, unavailability of telecommunication and delivery networks.

Article 5 – PAYMENT.

Payment for your purchases is made at the time of order. All payments are made online via the secure servers of PayPal and VivaWallet.

The consumer guarantees that he has all necessary authorizations to use the payment method. NEW BRUSSELS AQUARIUMS reserves the right to suspend any order in case of refusal of payment by banking organizations.

Article 6 – RIGHT OF WITHDRAWAL.

In the case of online sales, the Consumer has a right of withdrawal within 14 calendar days from the receipt of his/her order. This right does not apply to perishable goods, custom-made goods (e.g., aquariums), or if the products have been unsealed.

The Consumer must inform NEW BRUSSELS AQUARIUMS in writing of his/her intention to cancel by registered mail or by e-mail (info@brusselsaquariums.be). Return costs are at his/her expense.

The Consumer will return the product(s) within a maximum of 7 days. NEW BRUSSELS AQUARIUMS will process the refund within 30 days from the receipt of the returned products. Payment platform transaction fees will be deducted from the refund.

Article 7 – WARRANTIES.

All items sold benefit from the two-year legal guarantee from the date of the purchase invoice.

The warranty applies only in case of normal use. It is automatically refused in case of accident, fall, shock, short circuit, misuse, or improper installation. All live articles and frozen food are also excluded from the warranty.

Article 8 – LIABILITY.

NEW BRUSSELS AQUARIUMS offers and sells products compliant with Belgian legislation. Its liability cannot be engaged for inconveniences inherent in the use of the internet (service interruption, intrusion, virus) or for any case of force majeure.

Article 9 – PRIVACY PROTECTION.

Respect for your privacy is our priority. We comply with EU Regulation 2016/679 (GDPR). We only store the data necessary for the execution of sales contracts. We do not sell, trade, or rent your information to third parties.

Article 10 – INTEGRITY AND USE OF THE SITE.

The User undertakes not to use the site unlawfully. By using this site, he/she declares to have unreservedly accepted these general terms and conditions.

Article 11 – APPLICABLE LAW AND JURISDICTION.

These general terms and conditions are subject to Belgian law. In case of dispute, only the Courts and Tribunals of the French-speaking judicial district of Brussels have jurisdiction.
